Terms of Service

Applies to: the landing page and service offer shown at calcustom.ca and its sub-pages, including the “Free Custom Rendering in 48 Hours” offer (the Service).

These Terms of Service (the Terms) are a binding agreement between (“Cal Custom,” “we,” “us,” or “our”) and any person who visits our site or uses the Service (“you”). By using the site, submitting your information, or uploading a photo for a rendering, you agree to these Terms and to our Privacy Policy.

Quick summary (not a substitute for the full Terms):
We provide a free, no-obligation concept rendering based on a photo you upload. It’s for visualization only—not architectural, engineering, or construction advice. You must own or have permission to use anything you upload. We can decline or revoke the offer at our discretion. If you move forward with paid work, that will be covered by a separate written agreement.

2) Eligibility

You must be at least 18 years old and able to enter a binding contract. The free-rendering promotion is primarily intended for homeowners in our service area (currently greater Calgary); we may limit availability by location or other criteria.

3) Description of the Service

You may upload one or more photos of your space and give us basic preferences.

We will provide a non-final, conceptual visualization showing how an accent wall might look.

Unless we state otherwise in writing, the rendering is free and delivered within a target of 48 hours on business days (Mon–Fri, excluding holidays). This is a target, not a guarantee; delays may occur (e.g., poor photo quality, missing information, high demand).

We may request additional details or decline any submission at our discretion.

4) Not professional advice; visualization only

The rendering and any suggestions are for inspiration and planning. They are not architectural, engineering, or interior design plans, and are not guaranteed to meet building codes, safety requirements, or HOA rules. Colors, textures, and proportions in digital mockups may differ from real-world results due to lighting, screen calibration, and material variation. Always verify measurements, materials, and compliance before building.

5) User content and license

Your content. “User Content” means photos, text, and other materials you submit. You represent and warrant that:

you own the User Content or have all rights necessary to grant the license below;

the content does not infringe, violate, or misappropriate any third-party rights; and

the content is lawful, accurate to the best of your knowledge, and free of malware.

License to us. You grant Cal Custom a non-exclusive, worldwide, royalty-free license to host, reproduce, modify, and create derivative works from your User Content solely to: (a) provide the rendering and related customer service; (b) maintain internal records; and (c) improve our processes and quality assurance.

We will not publicly post your photos or renderings for marketing without your explicit permission. You can withdraw permission for future marketing use at any time by contacting us.

Sensitive or private items. Do not upload images containing sensitive personal information (IDs, medical documents, credit cards) or anything you do not want us to see. You are responsible for obscuring or removing such details before upload.

Storage and deletion. We may retain User Content as reasonably necessary to provide the Service and keep records, and we may delete it at any time in our discretion. See our Privacy Policy for data handling details.

6) Acceptable use

You agree not to:

upload illegal, defamatory, harassing, hateful, or pornographic content;

upload content of children in a private setting without verifiable consent of a parent or guardian;

attempt to probe, scan, or test the vulnerability of our systems;

interfere with or disrupt the Service or its security; or

misuse the Service in a way that could harm Cal Custom or others.

We may suspend or terminate access for violations.

7) Quotes, paid services, and separate agreements

The free rendering does not obligate you to purchase anything, and it is not a formal quote. If you request paid design or installation work, the pricing, scope, schedule, warranties, and payment terms will be governed by a separate written agreement signed by both parties. If these Terms conflict with a signed project agreement, the project agreement controls for that project.

8) Promotions and changes to the offer

We may modify, pause, or end the free-rendering promotion at any time (for example, limiting submissions per household or per month). Any savings claims (e.g., “save $1000s”) are estimates based on typical scenarios; actual savings vary.

9) Intellectual property (our content)

All content on the site (logos, text, graphics, videos, page layouts, and software) is owned by or licensed to Cal Custom and protected by law. You may not copy, distribute, or create derivative works from our content without our prior written consent.

10) Third-party services and links

We may use third-party tools (e.g., file-upload services, analytics, scheduling, or messaging). Your use of those tools may be subject to their separate terms and privacy policies. We are not responsible for third-party websites or services.

11) Electronic communications & marketing consent

By contacting us, submitting a form, or requesting a rendering, you agree we may contact you by email, phone, or text about your request. If you opt in to receive marketing, you consent to promotional messages; message/data rates may apply. You can unsubscribe from emails via the link in the message or text STOP to opt out of SMS. 12) Feedback

If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.

13) Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

14) Limitation of liability

To the fullest extent permitted by law, in no event will Cal Custom be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenues, data, or goodwill; or property damage arising from or related to your use of the Service. Our total liability for any claim will not exceed CAD $100 or the amount you paid to us for the Service giving rise to the claim (if any), whichever is greater. Some provinces do not allow certain limitations; in those cases, the above limits apply to the maximum extent permitted.

15) Indemnification

You agree to defend, indemnify, and hold harmless Cal Custom and our officers, directors, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your use of the Service; or (c) your breach of these Terms or violation of law.

16) Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason. Upon termination, Sections 5 and 9–18 survive.

17) Governing law; venue

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction and venue of the courts located in Calgary, Alberta, for any dispute not subject to informal resolution between us.

18) Changes to these Terms

We may update these Terms from time to time by posting a new version on our site. The “Effective date” above will show when the latest changes took effect. Your continued use of the Service after changes means you accept the updated Terms.
